State agencies and law enforcement officers are prohibited from assisting federal agencies in investigating, prosecuting, or enforcing federal firearm regulations enacted after January 1, 2021 that are more restrictive than North Dakota state law.

Defines "firearm accessory" as items used with or mounted on a firearm but not essential to basic function, including detachable magazines.

Three exceptions allow state assistance to federal agencies: federal court finds probable cause of national security threat, the violation also violates North Dakota law, or the violation violates specific state criminal chapters (12.1-16 through 12.1-41 and 19-03.1).

State and local law enforcement may still assist federal agencies on offenses unrelated to firearms or where firearms are incidental (drug offenses, homicide, assault, kidnapping, sex offenses, human trafficking).

Assistance is permitted when the investigation also involves a felony violation of state law.
