Amends section 61-16.2-06 to change the standard for permissible floodway uses from "no measurable decrease in hydraulic conveyance" to "no increase in flood levels during the occurrence of the base flood discharge."

Amends section 61-16.2-08 to require (rather than permit) uses within the flood fringe that do not violate other ordinances, regulations, or statutes.

Residential structures in the flood fringe must have lowest floors (including basements) elevated at least one foot above base flood elevation, unless granted a residential basement floodproof exception under the national flood insurance program.

Nonresidential structures in the flood fringe must be elevated at least one foot above base flood elevation or adequately floodproofed to no lower than two feet above base flood elevation, following the more restrictive standards adopted by the community or state.

Exceptions to these requirements require approval by the regulatory authority as a variance established in local floodplain development ordinances.
