Amends North Dakota Century Code section 49-06-02 to allow public utilities to include construction work in progress for new lignite-fueled electricity generation facilities in their property value for ratemaking purposes.

Requires the Public Utilities Commission to allow utilities using North Dakota lignite as primary fuel to recover research and development costs for cleaner, more efficient, or economical lignite use, including carbon dioxide capture and sequestration utilization, with a reasonable rate of return.

Permits utilities to recover incremental costs of complying with federal environmental laws through base rates or environmental surcharges, plus a reasonable rate of return on capital expenditures.

Allows utilities to recover all costs from coal severance taxes under chapter 57-61 and coal conversion taxes under chapter 57-60 through base rates and automatic adjustment clauses.

Enables utilities to recover costs for power purchase agreements of dispatchable on-demand generating units, plants, or facilities deemed to protect grid reliability, including a reasonable financial incentive.
