State officers are prohibited from expending amounts in excess of appropriations or using appropriated funds for purposes other than approved without prior transfer approval or expenditure authorization.

When an emergency exists, state officers may submit itemized petitions to the emergency commission secretary requesting approval to transfer funds, accept federal or contingency funds, accept other funds, or recommend full-time equivalent positions.

The emergency commission secretary must provide copies of all petitions to the office of management and budget, which may provide analysis and prioritization of emergency requests to the commission.

All emergency commission petitions must be considered and approved or recommended by the emergency commission before submission to the budget section for consideration.

Any debt or deficit created by a state officer in violation of these requirements is void, and section 54-16-03.1 of the North Dakota Century Code is repealed.
