Amends the definition of "location" for animal feeding operations in North Dakota Century Code section 58-03-11.1 to mean the setback distance between a structure, fence, or boundary enclosing an animal feeding operation and the nearest occupied residence, nonfarm/nonranch buildings, or land zoned for residential, recreational, or commercial purposes.

Clarifies that the definition excludes setback distances applied to manure or other recycled agricultural materials under a nutrient management plan approved by the Department of Environmental Quality.

Declares the Act to be an emergency measure.
