Governor may negotiate and execute tribal-state gaming compacts with federally recognized Indian tribes for online gaming and online sports betting, subject to section 54-58-03.

Federally recognized Indian tribes are classified as public-spirited organizations and are exempt from chapter 53-06.1 gaming regulations, except as agreed in the compact.

Online gaming and online sports betting may be conducted exclusively by federally recognized Indian tribes using servers located on tribal reservations within North Dakota.

Persons of legal age may participate in online gaming and online sports betting from any location within the state if conducted by a federally recognized tribe with servers on a tribal reservation, and account registration does not require in-person registration.

Any tribal-state gaming compact must address the scope of permitted gaming activities, geolocation, account encryption, age verification, and measures to prevent and mitigate online gaming addiction.
