Senate Bill No. 2323 Summary

• County and city governing bodies are prohibited from authorizing abortion facilities within 30 miles (48.28 kilometers) of a property line of any pre-existing public or private school.

• Existing abortion facilities that attempt to expand or rebuild must be denied permits and treated as nonconforming uses of the property.

• The prohibition applies to both county and city zoning authorities through amendments to chapters 11-09.1, 11-33, 40-05, and 40-05.1 of the North Dakota Century Code.
