SB 2333 - In-application Payment Prohibitions

• Prohibits digital application distribution platforms with over $10 million in cumulative gross receipts from North Dakota residents from requiring developers to use the platform's exclusive in-application payment system for software downloads or digital/physical product purchases.

• Forbids platforms from retaliating against developers who choose alternative payment systems or refusing them access to the platform based on their use of competing payment methods.

• Applies to platforms that distribute applications created by North Dakota-domiciled persons or provide applications to North Dakota residents, but exempts special-purpose platforms like gaming consoles and music players.

• Classifies violations as unlawful practices under section 51-15-02, allowing aggrieved persons to seek injunctions or restitution with court-awarded costs, expenses, and attorney's fees.

• Renders any agreements violating the provisions unenforceable and voidable.
