Adds auctioneer and clerk licenses under chapter 51-05.1 to the list of licenses subject to criminal history record checks by the public service commission, but makes such checks optional unless required by the commission.

Increases the annual license fee for auctioneers and clerks from $35 to $50, with late renewal fees of $25 assessed for applications not received by December 31st.

Requires applicants to file a corporate surety bond before licensure: minimum $5,000 for auctioneers and $10,000 for clerks, running to the state of North Dakota for protection against licensee misconduct.

Permits the public service commission to request first-time applicants pass a criminal background check, with the applicant bearing all associated costs.

Maintains existing license standards requiring applicants to be at least 18 years old, have good reputation for honesty and fair dealing, and either have one year of prior licensed experience or complete an approved course of study.
