North Dakota Department of Transportation shall conduct a study during the 2023-24 interim in consultation with the Tax Department and Public Service Commission on the feasibility of an electronic vehicle charging tax.

Study must assess lost gas tax revenue from out-of-state drivers using North Dakota roads with electrically charged vehicles that do not pay fuel taxes.

Study must evaluate the economic impact of lost revenue and compare it to the economic impact of implementing an electronic charging tax equivalent to lost gas tax revenue.

Study must assess the costs and implementation requirements for establishing such a tax.

Department of Transportation must report findings, recommendations, and any required legislation to legislative management by August 1, 2024.
