Amends North Dakota Century Code section 44-06.1-13.1 to allow notaries public to perform notarial acts for remotely located individuals using communication technology that enables simultaneous sight and sound communication.

Requires notaries to verify remote individual identity through personal knowledge, credible witness testimony, or at least two different types of identity proofing before performing notarial acts.

Mandates creation and retention of audiovisual recordings for all remote notarial acts, with recordings retained for at least ten years unless a different period is established by rule.

Requires remotely located individuals signing tangible records not physically present to sign a declaration under penalty of perjury and send the record to the notary within three days of the notarial act.

Requires notaries to notify the North Dakota Secretary of State before performing initial remote notarial acts and conform to any established standards for communication technology and identity proofing.
