HB 1139 Summary

• Amends North Dakota Century Code sections relating to birth record definitions and requirements to specify that sex designation on birth records must be either male or female based on the child's nonambiguous sex organs, chromosomes, and endogenous hormone profiles at birth.

• Prohibits entry of "not yet determined" for sex on birth records unless the sex cannot be determined based on biological factors at birth.

• Updates the definition of "sex" in statute to mean the biological state of being female or male based on the individual's nonambiguous sex organs, chromosomes, and endogenous hormone profiles at birth.

• Makes grammatical and technical changes throughout the statute, including replacing "when" with "if" and updating language regarding birth registration procedures in institutions and outside institutions.

• Passed House 81-11 and Senate 42-5 in the 2023 regular session.
