HB 1146 Summary

• Creates new section 54-52.1-04.19 requiring public employee health insurance plans to cover fertility health benefits including diagnosis of infertility, fertility treatment, and standard fertility preservation services if medically necessary and recommended by a physician.

• Mandates coverage include three completed cycles of intrauterine insemination and up to four completed oocyte retrievals with unlimited fresh and frozen embryo transfers to achieve two live births, performed at facilities meeting American Society for Reproductive Medicine or similar standards.

• Prohibits limiting fertility coverage through different copayments, deductibles, waiting periods, or restrictions compared to maternity benefits, and prohibits pre-existing condition exclusions for infertility diagnosis or treatment.

• Applies to health benefits coverage beginning after June 30, 2023, and expiring June 30, 2025, requiring the Public Employees Retirement System to report to the 69th Legislative Assembly on utilization costs and whether coverage should continue beyond the expiration date.

• Amends section 26.1-36.6-03 to include fertility health care requirements in self-insurance health plans subject to the insurance commissioner's jurisdiction.
