Individuals engaging in barefoot skiing or surfing may wear an approved wet suit designed for these activities (in good and serviceable condition and appropriate size) instead of a life preserver, but must have an approved life preserver on board the towing vessel.

Individuals aged 16 or older engaged in windsurfing or boardsailing are exempt from the life preserver requirement.

Barefoot skiing, water skiing, surfboarding, or similar towing activities are prohibited between one hour after sunset and one hour before sunrise on North Dakota waters.

Operators towing individuals on water skis, surfboards, or similar devices must have another observer in the vessel or equipment with a mirror at least 78 square inches providing an unobstructed rear view (exceptions apply to personal watercraft and organized water ski shows or tournaments).

Violations constitute a class 2 noncriminal offense.
