Creates a fertilizer development fund in the state treasury with continuing appropriation for grants and administrative costs managed by the Industrial Commission.

Limits grant awards to 20 percent of estimated project costs for fertilizer plants located in North Dakota owned by United States or Canadian entities, with 50 percent of funds designated for hydrogen-based projects and 50 percent for natural gas projects.

Establishes a nine-member fertilizer development council chaired by the Commissioner of Commerce, including representatives from agriculture, biodiesel, biomass, wind, ethanol, advanced biofuel, and petroleum industries appointed by the governor.

Protects trade secrets and proprietary information submitted to the commission and council from public disclosure, with procedures allowing requesters to designate materials as confidential.

Transfers $500,000,000 from the strategic investment and improvements fund to the fertilizer development fund during the biennium of July 1, 2023, through June 30, 2025.
