Amends North Dakota criminal mischief law to classify the offense as a class C felony if committed while engaged in a riot as defined in section 12.1-25-01.

Establishes theft offense grading based on whether property is stolen during a riot or while part of an organized group of five or more individuals.

Maintains existing criminal mischief penalties: class B felony for intentional pecuniary loss exceeding $10,000; class C felony for loss between $2,000-$10,000 or use of explosives/destructive devices; class A misdemeanor for reckless loss exceeding $2,000 or intentional loss of $100-$2,000; class B misdemeanor for all other offenses.
