Adds a new section to North Dakota Century Code chapter 39-34 establishing that transportation network company drivers are independent contractors, not employees, if specific conditions are met.

Defines "transportation network company" as an entity maintaining a digital network to facilitate services and accepting requests only through its digital network, not by phone, fax, or in-person.

Requires transportation network companies to: enter written independent contractor agreements with drivers, not unilaterally prescribe work hours, allow drivers to work for competitors and other employers, not terminate contracts for refusing specific service requests, and not prohibit use of vehicles with internal combustion engines.

Excludes freight and sealed package delivery drivers from the independent contractor classification.
