ND HB1410

Amends section 12.1-14-01 of the North Dakota Century Code to add a new class A misdemeanor offense for official oppression involving intrusive touching during airport security screening.

Makes it illegal for individuals acting under color of federal office or employment to touch the anus, sexual organs, area between belly button and sexual organs, buttocks, or breast of another person (including through clothing) without probable cause during passenger aircraft security screening.

Applies to federal officers, employees, agents, individuals under contract with federal agencies for security or law enforcement, and individuals acting under color of federal law.

Expands the definition of "public servant" to explicitly include federal officers, employees, agents, federal contractors providing security or law enforcement, and those acting under federal law authority.

Requires that the person committing the offense must know their conduct is illegal for conviction as a class A misdemeanor.
