Expands licensing requirements to include distributors and dealers of electronic smoking devices, requiring licenses from the North Dakota Attorney General before engaging in business.

Defines "electronic smoking device" as any device delivering aerosolized, vaporized, or heated nicotine substance, including e-cigarettes, vape pens, and e-hookahs, excluding FDA-approved drugs and batteries sold separately.

Extends record-keeping and reporting requirements for distributors from one year to three years for all tobacco products including electronic smoking devices.

Allows persons engaged in selling electronic smoking devices before July 1, 2018 to obtain dealer licenses without the one-year distributor license requirement.

Includes electronic smoking devices in penalties for unlicensed sales and revocation provisions, with violations subject to existing penalty structure for tobacco product violations.
