Creates new section 50-24.8-11.1 of the North Dakota Century Code establishing record-keeping requirements for Medicaid providers.

Requires providers submitting claims or receiving payments under the state's Medicaid program to create and retain records at the time goods or services are provided, as required by department rules and chapter 50-24.8.

Establishes criminal penalties for willful failure to create records, maintain records for the required duration, provide records upon request by the department or attorney general, or improper destruction of records: Class A misdemeanor if the value of payments or claims does not exceed $10,000; Class C felony if value exceeds $10,000.

Provides an affirmative defense if records were lost or destroyed in a natural disaster or by an act not resulting from the defendant's conduct.
