Amends North Dakota Century Code section 44-04-18.1 to establish penalties for unlawfully possessing or releasing exempt public employee records.

An individual violating possession or release restrictions is guilty of an infraction for each document if possessing ten or fewer documents.

A class B misdemeanor applies for releasing ten or fewer documents or possessing ten or more documents; a class A misdemeanor applies for releasing more than ten documents.

Public employees may possess exempt records of other employees only for official duties and must surrender the records upon completion of those duties.

Maintains existing confidentiality protections for employee medical records, employee assistance program use, and personal information including birth date, home address, phone numbers, financial account numbers, and dependent information.
