Creates Chapter 15-10.6 of the North Dakota Century Code requiring all intercollegiate and intramural athletic teams sponsored by higher education institutions to be expressly designated as males/men/boys, females/women/girls, or coed/mixed based on biological sex at birth.

Defines sex as biological state based on nonambiguous sex organs, chromosomes, and endogenous hormone profile at birth.

Prohibits female-designated athletic teams from being open to male students, while allowing male students to participate in male-designated or coed teams.

Prevents government entities, licensing organizations, accrediting organizations, and athletic associations from investigating or taking adverse action against institutions for maintaining separate female athletic teams.

Establishes private right of action for students deprived of athletic opportunities, students subjected to retaliation for reporting violations, and institutions harmed by violations, with civil actions limited to two years and prevailing parties entitled to damages, attorneys' fees, and costs.
