Department of Environmental Quality may require applicants for radioactive materials licenses or solid waste permits to undergo state and nationwide criminal history background checks.

Applicants must submit personal information and fingerprints, with all costs of the background check borne by the applicant.

"Applicant" includes the direct applicant plus partners, entities holding 10% or more of debt or equity, board members, officers, radiation safety officers, and holders of 10% or more of debt or equity.

Department may deny issuance, renewal, transfer, or major modification of a license or permit based on intentional misrepresentation, felony conviction within five years, court contempt within five years, or repeated violations of environmental protection laws.

Department must consider relevance of offense to the business, nature and seriousness of offense, circumstances, offense date, and ownership and management structure at time of offense.
