SB 2088 Summary

• Amends definitions for assisted living facilities to require at least five living units serving five or more unrelated individuals, with each unit containing a sleeping area, lockable entry door, and private bathroom.

• Requires entities operating assisted living facilities to obtain annual licensing from the Department of Health and Human Services and pay a $75 annual license fee per facility.

• Establishes enforcement mechanisms including fines up to $50 per day after 59 days of noncompliance, and allows the department to issue provisional licenses (valid up to 90 days, renewable once) or deny/revoke licenses for deficiencies.

• Exempts religious orders providing services to vowed members in retirement housing from licensing requirements under this chapter.

• Limits occupancy to no more than two people per bedroom in each living unit and repeals sections 50-32-02.1 and 50-32-03 of the North Dakota Century Code.
