Senate Bill No. 2125 Summary

• Amends North Dakota Century Code sections 23-06.5-06 and 23-06.5-17 regarding health care directives and agent appointments.

• Removes the requirement that an agent must accept appointment in writing; a health care directive now creates authority for the agent automatically upon the principal's incapacity.

• Agent may withdraw before the principal becomes incapacitated by notifying the principal, and after incapacity by notifying the attending physician.

• Updates the optional health care directive form to replace "person" with "individual" throughout the document and clarifies the form includes three parts: appointment of health care agent, health care instructions, and anatomical gift authorization.

• Specifies that at least one witness to the health care directive may not be a health care or long-term care provider giving direct care to the declarant.
