Amends section 43-17-42 of the North Dakota Century Code to allow hospitals, nonprofit entities, and charitable trusts to directly or indirectly employ physicians under a written contract.

Written employment contracts must include language stating the employer's relationship with the physician does not affect the physician's independent judgment in medical practice and that such judgment remains unaffected by the employment relationship.

Establishes that hospitals, nonprofit entities, and charitable trusts employing physicians under these conditions are not engaged in the practice of medicine.

Extends the same employment provisions specifically to nonprofit entities and charitable trusts conducting hyperbaric oxygen therapy with physician employees.

Passed the North Dakota Senate 45-0 (2 absent) and the House 91-1 (2 absent) in January 2023.
