Senate Bill No. 2193 Summary

• Motor vehicle dealers must possess a current license and cannot advertise as a dealer without a new or used motor vehicle dealer license.

• Annual license fee is $100 per year with one dealer plate issued; initial applicants must submit a nonrefundable $100 inspection fee and provide federal employer identification number or social security number.

• Licensed dealers may buy, sell, or exchange motor-powered recreational vehicles (with required surety bond) and trailers (with required surety bond), but these sales do not count toward minimum sales requirements.

• Violations result in escalating penalties: $100 fee for first violation, $200 fee for second violation within two years, and $500-$2,000 fee for third or subsequent violations within five years.

• A person unlicensed as a dealer who commits a third or subsequent violation is guilty of a class B misdemeanor.
