Retired teachers receiving annuities under North Dakota teacher retirement chapters may return to teaching in critical shortage areas without losing retirement benefits.

Retired teachers must teach in a school district, special education unit, regional education association, regional career and technical education center, or the North Dakota center for distance education to fill an unfilled position after August 1st following a thorough recruitment search.

Retired teachers and their employers must notify the fund office in writing within ten days of the retired member's return to covered employment.

Retired teachers must pay member contributions on their salary as required by section 15-39.1-09, which are added to their account value and cannot be refunded except under specific circumstances.

Employers must pay employer contributions required by section 15-39.1-09, and retired teachers remain treated as retired for all other purposes, cannot earn additional service credit, and remain ineligible for disability benefits available to active members.
