Senate Bill 2282 Summary

• Extends statute of limitations for civil claims involving sexual assault, sexual abuse, gross sexual imposition, or sexual contact to nine years after the act occurred, or twenty-one years if the act occurred when the plaintiff was under eighteen years of age.

• Establishes that for plaintiffs under fifteen years of age when the sexual act occurred, the twenty-one year limitation period does not begin until the plaintiff reaches fifteen years of age.

• Amends childhood sexual abuse claims to require actions be commenced within twenty-one years after the plaintiff knew or reasonably should have known a potential claim existed, with the clock starting at age fifteen if applicable.

• Waives the one hundred eighty day notice requirement for claims against the state when the claim involves sexual assault, sexual abuse, gross sexual imposition, or sexual contact as defined in chapter 12.1-20.

• Passed the Senate 47-0 and the House 56-33 during the 2023 regular session.
