Legislative management shall conduct a study during the 2023-24 interim on recording practices of local and state law enforcement during custodial interrogations, with assistance from the North Dakota commission on uniform state laws.

Study must determine the number of law enforcement agencies currently recording custodial interrogations and examine recording policies, storage and retention practices, equipment types, interrogation locations, and types of criminal investigations where recordings occur.

Study must evaluate current disclosure practices in criminal discovery, best practices for recording interrogations including the Uniform Electronic Recordation of Custodial Interrogations Act, financial costs, and barriers to uniform implementation.

Legislative management may seek assistance from the North Dakota commission on uniform state laws in developing recommended policies and procedures.

Legislative management shall report findings, recommendations, and any necessary legislation to the sixty-ninth legislative assembly.
