State agencies must grant new hires 40 hours of "new hire leave" to use within their first year of employment, which expires after the first year and is not paid out upon separation

Employers may grant enhanced annual leave (1-2 working days per month) at hire for positions previously identified as hard-to-fill occupations under section 54-06-31

Annual leave ranges from 1-2 working days per month based on tenure; sick leave ranges from 1 to 1.5 working days per month based on tenure

Passed the House 61-29 and Senate 36-10; effective date is May 1, 2026
