Private employers in North Dakota are prohibited from willfully hiring or continuing to employ unauthorized workers as defined by federal immigration law (8 U.S.C. Section 1324a(h)(3))

Individuals may file alleged violations with the Attorney General, who has authority to investigate and refer cases for prosecution

Civil penalties escalate with repeat offenses: $2,000 for first offense, $5,000 for second offense, and $10,000 for third or subsequent offenses

Applies to any private employer transacting business in the state with one or more employees
