ND HB1303

Prohibits the state, political subdivisions, and higher education institutions from adopting sanctuary policies that limit cooperation with federal immigration agencies, grant lawful status to undocumented individuals, or restrict compliance with ICE custody and transfer requests

Authorizes the Attorney General to investigate complaints about sanctuary policy violations and issue opinions with specific findings to non-compliant political subdivisions

Political subdivisions have 30 days to appeal an Attorney General opinion to district court or provide evidence that the sanctuary policy has been eliminated

Creates the sanctuary compliance fund in the state treasury; non-compliant political subdivisions lose their allocation from the state aid distribution fund until compliance is achieved

Withheld funds may be redistributed to compliant political subdivisions using existing formulas; any sanctuary policy adopted in violation is declared void
