Public entities may charge up to $0.25 per impression for paper copies (8.5 x 14 inches or smaller) and a reasonable fee covering actual labor, materials, and equipment costs for non-paper copies

Entities may charge up to $25 per hour for locating records and $25 per hour for redacting confidential material, excluding the first hour for each; five or more requests from the same person within seven days may be treated as one request

North Dakota citizens are entitled to one free records request per year (for locating and redacting) if the request takes 40 hours or less to fulfill

Public entities may require payment in advance before locating, redacting, making, or mailing copies, and may withhold records if a requester has unpaid balances from prior requests

Entities may not ask requesters for their identity, motive, or reason for requesting public records, though they may seek written clarification about which records are being requested
