Allows nonconforming residential structures damaged beyond 50% of their value to be repaired, replaced, or rebuilt in their entirety if a building permit is submitted within 6 months and restoration begins within 1 year of damage

Rebuilt structures must not exceed the original footprint, square footage, height, or number of stories, and cannot encroach on public rights-of-way or neighboring properties

Applies uniformly to counties, cities, and townships by creating parallel provisions in three sections of North Dakota Century Code (11-33-17.1, 40-47-05.1, and 58-03-14.1)

Maintains floodplain regulations to preserve eligibility in the National Flood Insurance Program, and permits local zoning authorities to adopt less restrictive ordinances

Passed the House 87-3 and the Senate 31-16 during the 69th Legislative Assembly session beginning January 7, 2025
