Organizations registering with the Secretary of State must file a statement certifying whether they are a "foreign organization of concern" alongside their articles of incorporation, articles of organization, or certificate of authority

Secretary of State must forward falsified ownership statements to the Attorney General if the filing violates property or land ownership laws (sections 47-01-09 or chapter 47-10.1)

Attorney General may prosecute violations in district court where the organization's registered agent is located or in Burleigh County

Willful violations constitute a class B misdemeanor

"Foreign country of concern" is defined as foreign adversaries under 15 CFR 791.4(a) or entities on the OFAC sanctions list; "foreign organization of concern" means organizations domiciled or formed in such countries
