Health care facilities (excluding nursing and basic care facilities) must publicly disclose standard charges for all items, services, and "shoppable services" as defined by federal regulations, using a format consistent with CMS rules.

Facilities with more than 25 beds face civil penalties of $10 per bed per day (up to $5,500/day) for transparency violations; smaller facilities face up to $100 per day plus interest and enforcement costs.

Health care insurers may terminate preferred provider contracts without consent if the provider fails to comply with federal price transparency rules.

Preferred provider arrangements must now include an attestation from the provider confirming compliance with federal transparency requirements.

The insurance commissioner has authority to assess penalties through civil court proceedings or administrative hearings, and may impose additional sanctions under existing rules.
