Removes the requirement that injured workers prove they have not retired or voluntarily withdrawn from the job market when reapplying for disability benefits after discontinuation

Eliminates automatic termination of disability, rehabilitation, and supplementary benefits when workers begin receiving Social Security retirement benefits or reach retirement age

Establishes new criteria for the retirement presumption to not apply: worker must be actively seeking employment, available for gainful employment, not have rejected bona fide job offers, and not have provided written notice of a scheduled retirement date

Exempts permanently and totally disabled employees from the retirement presumption entirely

Repeals sections 65-05-09.4 and 65-05-09.5 regarding additional benefits payable, with changes applying to all workers' compensation claims regardless of injury date
