Mandated reporters are exempt from reporting pregnant women's controlled substance abuse or alcohol misuse if they are actively providing or coordinating prenatal or substance abuse treatment services, including voluntary treatment program enrollment

Reporting becomes required if the pregnant woman discontinues prenatal care, stops following treatment recommendations, or continues substance/alcohol abuse

Toxicology testing requirements for pregnant women and newborns are changed from mandatory ("shall") to discretionary ("may") for physicians who have medical indications of substance use

Creates a new exemption for postpartum women, allowing providers to defer reporting while actively delivering postpartum or substance abuse services to the mother or infant

Repeals Section 50-25.1-18 relating to prenatal alcohol misuse reporting requirements; passed Senate 44-2 and House 57-36
