Adds a new category of theft for public servants who seize or confiscate private property located on an owner's real property without first providing written notice (in person or via certified mail) and obtaining the owner's signed acknowledgment of receipt

Prohibits political subdivisions, including home rule cities and counties, from seizing personal property from an individual's real property without providing advance written notice and receiving the owner's signature confirming receipt

Requires two conditions be met before any government seizure: written notice delivered in person or by certified mail, and the property owner's signature acknowledging the notice

Amends existing theft statute (Section 12.1-23-02) to include government actors who violate the notice requirements, making such seizures prosecutable as theft
