Nebraska Department of Health and Human Services must submit a Section 1115 Medicaid demonstration waiver application to CMS by July 1, 2026, to allow reimbursement for traditional healing services under the state's medical assistance program.

Traditional healing services are defined as culturally grounded practices supporting health and well-being, developed in consultation with tribal nations, tribal health authorities, and urban Indian organizations.

Services must be voluntary for Medicaid beneficiaries, cannot replace existing covered services, and must be delivered by providers meeting department-established eligibility criteria approved by CMS.

The department must consult with tribal nations and urban Indian organizations on service definitions, provider eligibility, reimbursement methodologies, evaluation measures, and confidentiality protections for culturally protected knowledge.

Implementation is contingent on federal CMS approval; if the waiver application is not submitted by the deadline, the department must report to the Legislature explaining the delay and providing an anticipated submission date.
