Defendants in criminal cases are entitled to damages if charges are dismissed, they are found not guilty at trial, or their conviction is overturned on appeal or through postconviction relief

Damages include reasonable attorney's fees, litigation expenses, and actual damages such as lost wages caused by arrest, detention, prosecution, conviction, or imprisonment

Defendants are not eligible for damages if convicted of another offense arising from substantially the same misconduct at the same or higher offense level

Defendants may waive damages through an agreement with the prosecutor to dismiss charges

Amends Section 29-1208 to add damages entitlement for defendants granted absolute discharge when not brought to trial within required timeframes
