Homeowners associations and similar mutual benefit organizations are prohibited from adopting or enforcing covenants, bylaws, deeds, or other agreements that ban or outright restrict solar energy collectors, solar energy systems, solar collection structures, or pollinator gardens

HOAs are prohibited from assessing or charging homeowners any fees for placing solar energy devices or pollinator gardens on their property

Any existing covenants or restrictions that violate these protections are declared void and unenforceable

Homeowners are granted a civil cause of action against HOAs or any other person who violates these provisions

Pollinator gardens are defined as gardens of any size designed to support pollinators (bees, butterflies, hummingbirds) by providing food, water, and shelter, provided they comply with local pollinator garden programs
