Municipalities and counties may authorize syringe services programs by ordinance or resolution to operate within their boundaries

Programs must provide needs assessments, sterile syringes and needles, safe disposal services, substance use disorder treatment referrals, overdose risk information, naloxone access, and referrals to social and mental health services

Programs cannot be located within 500 feet of schools, child care facilities, youth centers, libraries, community recreation centers, or public swimming pools, and may only serve individuals 18 years or older

Staff and participants of authorized syringe services programs are exempt from drug paraphernalia penalties under the Uniform Controlled Substances Act when engaged in program-related activities

Amends sections 28-441 and 28-442 of the Revised Statutes to add these exceptions to existing drug paraphernalia laws
