Licensed tobacco retailers are banned from making delivery sales (mail, internet, phone, or electronic methods) of nitrous oxide products to Nebraska consumers, with violations constituting a Class I misdemeanor and a deceptive trade practice

Sale of equipment specifically designed for inhaling nitrous oxide recreationally, or knowingly sold for that purpose, is prohibited with penalties of Class III misdemeanor for first offense and Class II misdemeanor for subsequent offenses

All nitrous oxide products sold in violation of these provisions are subject to seizure, forfeiture, and destruction, with costs borne by the person from whom products are seized

Exemptions apply to shipments to foreign trade zones where products originate outside the U.S. and are destined for out-of-state distributors, and to government employees acting in official duties
