Enhances criminal penalties by one classification level for specified offenses committed in disaster areas during emergency periods declared by the Governor, local authorities, or the President

Covered offenses include assault (first, second, and third degree), robbery, arson, burglary, theft, criminal mischief, criminal trespass, and burning to defraud an insurer

Emergency periods default to 30 days if no end date is specified in the proclamation, declaration, or evacuation order

Class I misdemeanors committed under these circumstances would be elevated to Class IV felonies

Prosecutors must include enhancement allegations in the indictment and prove them beyond a reasonable doubt during trial
