Health care staffing agencies operating in Nebraska must register annually with the Department of Labor and pay a $1,500 registration fee per location, with the act becoming operative January 1, 2026

Agencies are prohibited from including noncompete clauses in contracts with staff workers or health care entities, and cannot require payment of liquidated damages or fees if a staff worker is subsequently hired permanently by a health care entity

Registered agencies must maintain professional and general liability insurance with minimum coverage of $1 million per occurrence and $3 million aggregate, and must submit quarterly reports detailing average amounts charged to health care entities and paid to staff workers

The Commissioner of Labor may assess civil penalties of up to $500 for first offenses and $5,000 for subsequent violations, or revoke registration for one calendar year for failures to register, violations of requirements, or knowingly providing workers with fraudulent credentials

The Department of Labor must create a publicly accessible database of registered health care staffing agencies and establish a complaint system, with authority to conduct random audits and investigations with at least three business days' notice
