Creates new criminal offense of "organized retail crime" defined as theft of retail merchandise with intent to resell, distribute, or transfer to others in exchange for value

Prohibits specific actions including: committing organized retail crime, organizing/supervising/financing such crimes, tampering with anti-shoplifting devices, conspiring with others, possessing merchandise a reasonable person would know is stolen, and manipulating fire exit alarms during theft

Class IIA felony for merchandise valued at $5,000 or more; Class IV felony for $1,500 to $4,999; Class I misdemeanor for $500 to $1,499

Second or subsequent misdemeanor conviction elevates to Class IV felony; prior convictions within 10 years can enhance penalties

Allows aggregation of multiple thefts under one scheme in a single charge; aggregate retail market value must be proven beyond a reasonable doubt as an essential element
