Persons, manufacturers, and distributors who donate apparently usable menstrual products in good faith to nonprofit organizations are immune from civil and criminal liability for injuries or deaths related to the product's nature, age, packaging, or condition

Nonprofit organizations that receive and distribute donated menstrual products in good faith receive the same civil and criminal liability protection

Immunity does not apply in cases of gross negligence or intentional misconduct that results in injury or death to a product user or recipient

"Apparently usable" requires the product to meet all federal, state, and local quality and labeling standards, regardless of whether it is readily marketable

"Menstrual product" is defined to include sanitary napkins, tampons, liners, cups, underwear, and similar items used for menstruation
