Cities of the first and second class and villages that own and operate natural gas systems may enter into contracts to sell natural gas to industrial consumers by January 1, 2027

Eligible industrial consumers must have facilities located in Nebraska within 100 miles of the contracting city or village and require at least 3 billion British thermal units of natural gas per day (annual average)

Contract terms must be at least two years and may include renewal and extension options; the industrial consumer cannot be a current customer of any competitive natural gas provider

City councils or village boards must adopt a resolution stating the contract does not pose unreasonable financial risk to the municipality or its taxpayers before entering the agreement

Industrial consumers must not have received gas service from any investor-owned or government-owned gas system within five years prior to contract execution
